A US LLC can be a contracting and bookkeeping structure for a creator business. It does not automatically change who owns the income or remove Google’s US withholding.
Before changing an AdSense for YouTube payment profile, identify the income owner, the LLC’s tax classification and each revenue stream. Channel royalties, sponsorship work and merchandise sales do not all follow one rule.
Why Google withholds on some YouTube earnings
Google’s US tax requirements for YouTube earnings explain that it collects tax information and withholds where required on royalty revenue from US viewers.
As of October 2026, Google states that creators outside the US who provide valid tax information face withholding rates between 0% and 30% on earnings from US viewers. The rate depends on the relevant tax information and treaty entitlement. A lower rate is not available merely because you have a US company.
Without valid information, different default or backup-withholding rules can apply, potentially to worldwide earnings. Do not treat the US-viewer limitation as unconditional.
Check the accepted tax information and withholding rate against your actual situation. Keep Google’s final payment records; audience analytics alone are not the final tax statement.
The beneficial owner matters more than the EIN
The beneficial owner is the person treated as owning the income for the relevant tax rules. For a disregarded single-member LLC, that is generally its owner.
The IRS W-8BEN instructions say the single owner of a disregarded entity is considered the beneficial owner of income it receives. An employer identification number (EIN) is the LLC’s US tax ID. It does not turn its foreign owner into a US person.
A foreign individual generally documents foreign status on W-8BEN. A foreign entity generally uses W-8BEN-E. Qualifying effectively connected income (ECI) can require W-8ECI. Do not use W-9 solely because the payment account carries a US LLC name.
Google’s tax-information guidance distinguishes these forms and discusses disregarded entities. If the generated form conflicts with your ownership or classification, ask Google Support and your adviser to resolve it. Do not choose an inaccurate account answer to obtain a preferred rate.
Separate royalties from sponsorship services
Create separate income categories before your first monthly close.
| Income stream | What to document |
|---|---|
| YouTube Partner Program revenue | Platform statements, US-viewer earnings and withholding |
| Sponsored production or promotion | Contract, deliverables and where work was performed |
| Content licensing | Rights granted, permitted territories and contract term |
| Merchandise sales | Orders, inventory locations, refunds and sales tax |
| Affiliate commissions | Agreement, payment basis and settlement reports |
Services are generally sourced where the work is performed. Copyright royalties generally follow where the property is used. The IRS income-source summary separates those rules.
A sponsorship agreement can include both production work and rights to reuse the video. Give your preparer the contract rather than assuming the whole payment is a service fee because you filmed abroad.
US travel, a studio, staff or representatives can also affect the US trade-or-business analysis. An LLC, EIN and bank account alone do not establish ECI or guarantee exemption. See our ECI guide.
Withholding does not complete the LLC’s filings
A single-member LLC is usually disregarded for federal income tax unless it elects corporate treatment. Its income is generally treated as the owner’s. A domestic multi-member LLC normally follows partnership rules and generally files Form 1065.
A wholly foreign-owned disregarded LLC needs Form 5472 with a pro-forma Form 1120 when it has reportable related-party transactions. The IRS instructions include owner contributions and distributions. A channel with no revenue can still have reportable funding or personally paid business expenses.
This information return is separate from tax withheld by Google and any personal US return. An individual may need Form 1040-NR because of US business activity, insufficient withholding or a refund claim. A US citizen or US tax resident living abroad has a different filing framework.
Reconcile statements without counting income twice
Keep the gross earnings, withholding, adjustments and net payout visible. If Google deducts tax before sending money, the bank deposit alone does not show the full transaction.
Save any Form 1042-S issued for eligible payments and compare it with Google’s payment records. If another provider issues Form 1099-K, that form reports gross payment transactions, not business profit. The IRS 1099-K guidance explains the need to account for fees, refunds and other adjustments.
Do not add a tax form to revenue already recorded from the same payments. Reconcile it instead. Investigate mismatched names, duplicate reporting or amounts before preparing the return.
Keep production invoices and owner transfers separate. An owner withdrawal from a disregarded LLC is not automatically a deductible salary expense.
Check your home country and state obligations
Your country of tax residence may tax creator income even when the payer or bank is in the US. Ask how it classifies the LLC and whether US withholding qualifies for a local foreign tax credit. Relief depends on local rules and, where relevant, the treaty; it is not automatic.
Keep the withholding documents for that review. A timing or taxpayer-name mismatch can make the analysis harder.
State sales taxes on merchandise or digital products, and state income or business taxes, are separate from Google’s federal withholding. Identify any US operations and sales channels for a state-by-state review rather than assuming the LLC’s formation state settles everything.
FAQ
Will a US LLC stop YouTube withholding?
Not automatically. The beneficial owner, tax classification, income and valid treaty claim determine the relevant treatment.
Is every AdSense payment a royalty?
No. Google’s guidance distinguishes YouTube Partner Program royalties from services such as other AdSense income. Identify the product and payment category.
Can I claim back all tax Google withheld?
Not necessarily. Whether withholding was correct, whether a treaty applies and whether a refund procedure is available depend on your facts. Do not assume forming an LLC creates a refund entitlement.
Keep the channel’s finances ready for review
Our accounting service provides monthly reconciliation and financial statements. Share platform reports, sponsorship contracts, expenses and owner transfers. Standalone accounting does not include tax filings. Our federal service’s personal-return coverage is limited to qualifying LLC business-income cases, not every royalty-withholding refund claim; confirm scope before ordering.
